Privacy Policy

1Introduction

This Privacy Policy explains how AskKEMP.ai Limited ("We", "Us", or "Our") collects, uses, and discloses your Personal Data in connection with your use of the AskKEMP.ai platform (the "Platform").

We are committed to protecting your privacy in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO") and other applicable data protection laws, including the United Kingdom and European General Data Protection Regulation ("GDPR").

This policy applies to all users of Our Platform ("You" or "User"), regardless of their location. We are dedicated to providing you with the data protection rights afforded to you under your local laws.

2Personal Data We Collect

For the purposes of this Policy, "Personal Data" means any information that relates to an identified or identifiable individual, in accordance with applicable data protection laws.

We collect the following categories of Personal Data:

  • (a)
    Account and Contact Data: Your name, email address, and physical address.
  • (b)
    Financial Data: Payment card details and billing address. Please note that this information is collected and processed directly by our third-party payment processors and is not stored by Us.
  • (c)
    Usage Data: Information relating to your use of the Platform, specifically the volume of tokens consumed.
  • (d)
    Technical Data: Your IP address, browser type and version, and other technology on the devices you use to access the Platform.

3User-Generated Content and Platform Data

We have designed the Platform to minimise the retention of your sensitive information. It is crucial to understand how the different types of data you provide are handled:

(a) User Inputs and AI Outputs

Your queries and the responses generated by the Platform (collectively, “Chats”) are stored locally in your web browser. Your Chats are private and not accessible to others. These Chats will no longer be available if you switch to a different browser or device, unless you download the Chats beforehand.

While Chats are ongoing, they are temporarily stored in our Platform’s global buffer to maintain chat history. We do not use this data except to provide the necessary historical context for your Chats. After each Chat session, you may manually delete the session, which will also delete the Chats from the global buffer. If you do not manually delete your Chats, the global buffer will automatically clear itself on the third (3rd) day of each month, and all Chats within that period will be deleted.

For your own records, the Chats will remain in your private web browser, accessible only to you, until you clear your browser memory. We have no access to data stored in your browser.

(b) Third-Party Providers

The substance of your queries and the responses generated by the Platform are transmitted to our third-party Large Language Model (LLM) providers for processing. We either contract directly with these LLM providers or use pass-through providers such as OpenRouter. We rely on the privacy and security policies of our chosen LLM providers to govern the data while it is being processed. However, we only select reputable LLM providers whose stated policies confirm that they do not use the data for model training. For pass-through providers, we select only those with Zero Data Retention (ZDR) policies.

(c) User Knowledge Base (My Scrapbook)

If you choose to upload documents to create a persistent knowledge base, this data is stored in a vector database hosted by us. This storage is segregated by user, meaning other users cannot access your data. However, for the purposes of system maintenance, security, and service provision, authorised personnel of AskKEMP.ai may have access to this database. We do not use your data for any other purposes. If you do not wish for your data to be accessible to our personnel, you should delete the data from your knowledge base after each use.

My Scrapbook is intended to store your personal preferences, generic know-how, templates, lexicons, and other non-sensitive data. DO NOT USE MY SCRAPBOOK FOR CONFIDENTIAL DATA.

(d) Temporary Session RAG Uploads

For each session, you may upload documents to the Session RAG for queries.

Session RAG stores documents in a searchable vector database, which is ideal for reference materials. Documents uploaded are stored in our Session RAG database in vectorised form. Like the User Knowledge Base (see above), this storage is segregated by user, meaning other users cannot access your data. However, for the purposes of system maintenance, security, and service provision, authorised personnel of AskKEMP.ai may have access to this database. We do not use your data for any other purposes. If you do not wish for your data to be accessible to our personnel, you should delete the data after each use.

Session RAG documents are available only for the specific session in which the user uploaded them. There is no cross-session or cross-bot sharing mechanism.

Session RAG is designed for the temporary uploading of documents for queries. Session RAG documents ARE DELETED:

  • When you explicitly delete a chat session (by clicking the trash icon on a session).
  • When you click “Delete All Sessions”.
  • When you manually delete an individual session document via the Session RAG panel.

Session RAG documents ARE NOT DELETED:

  • When you close your browser tab or navigate away.

There is an auto-purge of Session RAG documents older than three (3) days, ensuring that your Session RAG documents are never retained indefinitely.

SESSION RAG IS DESIGNED FOR UPLOADING AND USING CONFIDENTIAL DATA FOR QUERIES DURING A PARTICULAR SESSION ONLY.

(e) Full Documents Upload

Full Documents Upload is one of AskKEMP.ai’s most powerful features. It sends the entire document to the Platform for complete analysis. It has cross-bot and cross-session functionality, meaning you can access documents uploaded to Full Documents Upload from any bot or session. It is best suited for contract review or case analysis.

When you upload a document (or save a conversation) through Full Documents Upload, the document is automatically stored in our SQL database. Like the other storage systems (see above), this storage is segregated by user, meaning other users cannot access your data. However, for the purposes of system maintenance, security, and service provision, authorised personnel of AskKEMP.ai may have access to this database. We do not use your data for any other purposes. If you do not wish for your data to be accessible to our personnel, you should delete the data after each use.

By default, documents uploaded to Full Documents Upload will be purged approximately every two (2) hours. Users may make a document persistent by clicking the “Lock” button. They may toggle it back to temporary by clicking the “Timer” button. If they do so, the document will be purged approximately two (2) hours thereafter.

If you wish to enhance privacy further, you may manually delete the document immediately after use by clicking the “Garbage Bin” icon.

FULL DOCUMENTS UPLOAD IS DESIGNED FOR UPLOADING AND USING CONFIDENTIAL DATA FOR DOCUMENT REVIEWS, DRAFTING, AND OTHER PURPOSES WHERE IT IS ESSENTIAL FOR THE AI TO “HAVE THE FULL PICTURE” RATHER THAN CHUNKS OF DATA.

(f) System Logs

We maintain logs of system activities solely for troubleshooting, security, and platform maintenance purposes. These logs contain metadata and do not include the substantive content of your Chats or documents. These logs are strictly confidential and are not shared with any third parties.

4Lawful Basis for Processing (For UK/EEA Users)

If you are located in the United Kingdom or European Economic Area, We are required to identify a lawful basis for processing your Personal Data. We rely on the following:

(a) Performance of a Contract

We process your Account and Contact Data, Financial Data, and Usage Data to create and manage your account, process subscription payments, and provide the Platform's services to you under our Beta Test Disclaimer & Terms of Service.

(b) Legitimate Interests

We process Technical Data and System Logs to maintain the security, integrity, and functionality of our Platform. We also rely on legitimate interests when Our authorised personnel access User Knowledge Base data or Temporary File Uploads for essential maintenance. We will only do so where Our legitimate interests are not overridden by your data protection rights.

(c) Consent

Should We wish to send you direct marketing communications in the future, We will only do so with your explicit prior consent.

5How We Use Your Personal Data

We use your Personal Data for the following purposes:

  • (a)To register you as a new user and manage your account.
  • (b)To provide, operate, and maintain the Platform and its services.
  • (c)To process your payments via Our third-party payment providers.
  • (d)To communicate with you regarding your account, including sending service-related announcements and responding to your enquiries.
  • (e)To comply with our legal, regulatory, and professional obligations.

6Disclosure of Your Personal Data

We do not sell your Personal Data.

We may share your Personal Data with the following categories of third parties:

(a) Third-Party Service Providers

Such as payment processors and cloud hosting providers who are necessary for the provision of the Platform.

(b) Third-Party AI Platforms

We disclose your User Input to these platforms for the sole purpose of generating the AI Output for you. We are not involved in and do not benefit from any subsequent use of this data by the LLM provider.

(c) Professional Advisers and Regulatory Authorities

Including lawyers, auditors, and regulators where We are required to do so by law or to protect Our rights.

We take care to ensure that any third party with whom We share your Personal Data is contractually bound to protect it and use it only for the purposes for which it was disclosed.

7International Data Transfers

We are based in Hong Kong. Our server is currently based in Singapore. When you use our Platform, your Personal Data is collected in your country and transferred to Hong Kong/Singapore for processing. Furthermore, your User Input is transferred to our Third-Party LLM providers, who may be located in other jurisdictions (such as the United States).

For users in the UK and EEA, such transfers outside of your jurisdiction require Us to have appropriate safeguards in place. For transfers to jurisdictions not deemed to have an adequate level of data protection, We rely on Standard Contractual Clauses as approved by the relevant authorities to ensure your Personal Data is protected to a standard equivalent to that within the UK/EEA.

8Data Security & Retention

We have implemented appropriate technical and organisational security measures to protect the Personal Data we store (such as your Account and Contact Data) from accidental loss, unauthorised access, alteration, or disclosure.

We retain Personal Data and other user data in accordance with the nature and function of each feature of the Platform, as follows:

Account and Contact Data

Retained for the duration of your subscription or account registration, and for a reasonable period thereafter for administrative, legal, and compliance purposes.

User Knowledge Base (My Scrapbook)

Retained for as long as you choose to keep it. You may delete this data at any time. If not deleted by you, it will remain stored until account termination or manual deletion.

Session RAG Documents

Deleted when:

  • You explicitly delete a chat session;
  • You click “Delete All Sessions”; or
  • You manually delete an individual session document.

Session RAG documents are not deleted when you close your browser tab or navigate away.

Session RAG documents are automatically purged if they are older than three (3) days.

Full Documents Upload

By default, documents are purged approximately two (2) hours after upload.

You may make a document persistent by clicking the “Lock” button.

Persistent documents may be toggled back to temporary status, in which case they will be purged approximately two (2) hours thereafter.

User Inputs, AI Outputs, and Chat History

Chats are stored locally in your browser.

During an active session, Chats are temporarily stored in a global buffer solely to maintain session continuity and context.

The global buffer is cleared:

  • When you manually delete a session; or
  • Automatically on the third (3rd) day of each month.

We do not retain Chats beyond these mechanisms and do not have access to data stored in your browser.

System Logs

Retained for troubleshooting, security, and platform maintenance purposes. These logs contain metadata only and do not include the substantive content of your Chats or uploaded documents.

9Your Legal Rights

Depending on your location, you may have the following rights in relation to your Personal Data:

(a) Right of Access

The right to be provided with a copy of your Personal Data.

(b) Right to Rectification

The right to require Us to correct any mistakes in your Personal Data.

(c) Right to Erasure

The right to require Us to delete your Personal Data in certain situations ("Right to be Forgotten").

(d) Right to Restrict Processing

The right to require Us to restrict the processing of your Personal Data in certain circumstances.

(e) Right to Data Portability

The right to receive your Personal Data in a structured, commonly used and machine-readable format.

(f) Right to Object

The right to object to our processing of your Personal Data in certain situations.

10Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. You are advised to review this Privacy Policy periodically.
